Buhari has not appointed new service chiefs – Femi Falana

Human Rights Lawyer, Femi Falana (SAN), has declared President Muhammadu Buhari’s appointment of latest service chiefs as unlawful and unconstitutional.

Buhari appointed new service chiefs on Tuesday following the resignation of the previous officers.

However Falana, in an announcement he personally signed on Wednesday, quoted a 2013 judgment which described such appointments with out the concurrence of the Nationwide Meeting as unlawful and unconstitutional.

For that reason, Falana stated that Buhari solely nominated the service chiefs and didn’t appoint them.

“Yesterday, President Buhari was reported to have appointed new service chiefs for the armed forces.

“Upon a crucial overview of the regulation on the subject material the members of the Alliance on Surviving COVID-19 and Past (ASCAP) have discovered that the appointments stay inchoate as President Muhammadu Buhari has not forwarded the names of the proposed service chiefs to the Nationwide Meeting for approval in strict compliance with the related provisions of the Structure and the Armed Forces Act.

“The appointments of service chiefs with out the concurrence of the Nationwide Meeting which had been the apply since 1999 was challenged within the Federal Excessive Courtroom someday in 2008 by Mr. Festus Keyamo SAN within the case of Keyamo v President Goodluck Jonathan (unreported Swimsuit No FHC/ABJ/ CS/611/2008).

Falana identified that the Federal Authorities didn’t problem any side of the judgment on the Courtroom of Enchantment having acknowledged it as sound and unimpeachable.

He defined that the judgment was binding on all authorities and individuals in Nigeria in accordance with the provisions of part 287 of the Structure.

The senior lawyer requested President Buhari to ship the names he had chosen to each chambers of the Nationwide Meeting for affirmation.

Buhari has obtained a variety of commendation from Nigerians for summoning up the braveness to sack the previous service chiefs who many Nigerians believed had misplaced the concepts to deal with insecurity within the nation.

The brand new service chiefs, as DAILY POST had earlier reported, are: Main-Common Leo Irabor as Chief of Defence Workers; Air Vice Marshal Isiaka Oladayo Amao as Chief of Air Workers; Rear Admiral Awwal Zubairu Gambo as Chief of Naval Workers; and Common Ibrahim Attahiru as Chief of Military Workers.

In the meantime, Femi Adesina, the President’s Spokesman, stated that his principal felt it was the most effective time to take away the service chiefs and appoint new ones.

In line with Adesina, “the President knew the time to do it and I consider the time has come and that’s the reason it has been performed.”

He added that the service chiefs didn’t resign on account of various safety failures below their tenure.
